Terms And Conditions Of Sale
All trees are fresh dug and secured in burlap wrap and wire basket to help protect the tree ball in transport from our field to customer location.
Chester County Trees will dig trees up to 8' and 9' tall.
We will load our trees onto your truck or trailer. Customer must make other arrangements for transporting (delivery) and planting of our trees.
Our tree service associate(s) will deliver and plant our trees from 9' up to 17' and 18' tall.
Tree staking, mulching, fencing, watering and all aftercare is the responsibility of customer.
100% Satisfaction Guarantee:
Because the success of our business depends on customer satisfaction and referrals and because it only seems fair, we will consider replacement of any tree that we sell if it fails within one year for no apparent reason - not including owner neglect or negligence due to lack of water, too much water (drowning), other aftercare error, misuse of chemicals or fertilizers, or environmental or severe weather conditions that might cause the tree to fail.
50% Replacement Guarantee:
For up to one year, a failed tree may be replaced with the same tree species and size for up to 50% of the amount paid for the tree if it is determined by us that the tree did not fail for any reason as described above.
In additon, the replacement guarantee does not apply when a tree is planted in extremely poor soil such as construction backfill dirt or similar waste dirt, stones, rocks, and other construction debris or when planted in high risk locations such as extremely dry soil or on a steep hill or on top a mound such as around a water swale zone where natural water is likely to be very limited.
Replacement is not guaranteed when planted in extremely wet soil such as a water run-off area or underground spring or ponding area.
Evergreen trees planted under or near walnut trees are not guaranteed.
Walnut tree roots, branches, leaves, and fruit are extremely toxic and hazardous to most plants and trees including most evergreen trees.
Although most evergreen trees will survive in the vicinity of walnut trees, they will usually grow thin and sometimes weak.
In rare cases, the evergreen tree may die as a weak and thin tree may be vulnerable to bugs and disease.
In most cases, raking the leaves and removing the fruit promptly may improve the health and quality of the evergreen tree.
Note: We do not guarantee tree needle color or appearance. All evergreen tree needles can differ slightly in color and appearance. Typically, what you see now is what you get in appearance. Color, especially in Colorado Blue Spruce, can change depending on your soil condition and moisture, planted location (full sun), and how you care for your tree.
Claims for any cause must be made within one year (365 days) from receipt of trees for tree guarantee to apply.
Each claim will be considered on an individual basis and will be resolved in a reasonable and fair manner.
Chester County Trees will not entertain claims due to negligence of customer or other service provider for customer including pick up, transporting, or planting or other third party services.
Chester County Trees is not responsible or liable for any third party services or disputes after the trees are removed from our field by such party.
Chester County Trees liability does not exceed the dollar amount received by Chester County Trees for such trees in question.
Terms: All sales are C.O.D. All trees accepted by customer must be paid in full upon pick up. Chester County Trees reserves the right to cancel any part or all of any order in the event of crop loss, damage, or shortages. All orders are subject to government regulations, weather, and all conditions beyond our reasonable control.
Customer Pick Up Orders: Trees become your property upon pick up.
At the time the trees are picked up by customer, customer agrees that trees are fresh dug and in good health and not guaranteed to survive any further environmental, accidents, mishandling, planting or unforeseen weather or aftercare conditions as it is the responsibility of customer to make sure the trees are carefully and properly handled and provided good aftercare such as tree staking, mulching, fencing and watering as applicable or necessary thereafter.
Chester County Trees may, under certain circumstances and according to our guarantee, determine that a tree merits replacement due to no obvious fault of customer.
Chester County Trees will not be liable or responsible for the condition of trees that are not picked up within seven days of customer notification that the order is ready.
Customer owned, leased, or rented trucks need to supply adequate tree support at rear of truck and/or trailer, proper strapping and suitable tarp to protect trees during transit.
Cancellations: Chester County Trees must receive a cancellation request in reasonable time before the expected digging date for a full refund.
If customer cancels an order of any tree(s) already dug, customer may be charged up to 25% of tree cost for handling, stocking, and aftercare and refunded accordingly.
Returns: After a tree is picked up, a tree may be returned and may be reimbursed or refunded up to 25% of tree cost.
The returned tree must be in same conditon as left our tree field and not already planted or partially planted for a refund to apply.
Payment: Chester County Trees accepts cash, check, or money order for payment. Chester County Trees does not accept credit card payment.
A 50% deposit (down payment) of tree total is required on all orders before digging begins.
After deposit, an invoice will be generated and emailed or mailed to summarize the entire agreement and balance due upon delivery.
All plant, bush, and tree sales are subject to 6% Pennsylvania Sales Tax.
Prices quoted on this website replace all previous quotes and are subject to change without notice.
All orders are booked and processed on the distinct understanding that customer understands and agrees to the terms and conditions of sale as stated above.
IMPORTANT: Prior to digging to plant on your property, contact the proper company or municipality for the location of underground utilities such as water, electric, and sewer lines!
Also, locate private lines such as irrigation systems, wiring for landscape lighting, water lines that serve water fountains or ponds, or any other underground lines or obstacles!
